1. General Terms and Conditions of Sale

These terms of sale are entered into, on one hand, by the company "SCI BEAUSOLEIL," with its registered office located at Résidence Martyrs, 14 Rue des Martyrs de la Résistance, 06240 Beasuoleil, registered under the company number 905 028 890 R.C.S. Nice, hereinafter referred to as "Résidence Martyrs," and on the other hand, by any natural or legal person wishing to make a purchase via the "Résidence Martyrs" website, hereinafter referred to as "the buyer."

2. Object

These terms of sale aim to define the contractual relationship between Résidence Martyrs and the buyer and the conditions applicable to any purchase made through the Résidence Martyrs merchant site, whether the buyer is a professional or a consumer.

The acquisition of a service through this site implies the buyer's unreserved acceptance of these conditions of sale.

These conditions of sale will prevail over any other general or specific conditions not expressly approved by Résidence Martyrs.

Résidence Martyrs reserves its right to modify its conditions of sale at any time. In this case, the applicable conditions will be the ones in force on the date of the buyer’s order.

3. Characteristics of the Goods and Services Offered

The products and services are the ones who appear in the catalog published on the Résidence Martyrs website.

Each product is accompanied by the most precise description possible.

The photographs in the catalog are as faithful as possible but cannot ensure a perfect similarity with the product offered.

4. Prices

Prices appearing in the catalog are inclusive of VAT in euros, taking into account the VAT applicable on the day of the order. Any change in the rate may be reflected in the price of the products or services.

Résidence Martyrs reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.

5. Orders

The buyer, who wishes to purchase a product or service, must:

• Complete the identification form, providing all the requested contact details or giving their customer number if they have one.

• Complete the online order form, providing all the references of the chosen products or services.

• Validate the order after checking it.

• Make payment under the conditions provided.

• Confirm the order and payment.

The confirmation of the order implies acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them, and waiver of the right to rely on one's own conditions of purchase or other conditions.

All the data provided, and the recorded confirmation will constitute proof of the transaction. The confirmation will be considered as signing and accepting the transactions.

The seller will communicate, by email, confirmation of the registered order.

6. Withdrawal

Buyers, non-professional individuals, benefit from a withdrawal period of seven days from their order. The withdrawal request must be made by registered letter with acknowledgment of receipt to this address: SCI BEAUSOLEIL – Résidence Martyrs, 14 Rue des Martyrs de la Résistance, 06240 Beausoleil.

7. Payment Terms

The price is due at the time of ordering.

Payments will be made by credit card. They will be carried out through the secure "Stripe" system, which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software, and no third party can read it during transport on the network.

Upon the buyer's request, a paper invoice showing VAT will be sent.

8. Responsibility

The seller, in the online sales process, is only bound by an obligation of means; its responsibility cannot be engaged for damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.

9. Intellectual Property

All elements of the Résidence Martyrs site are and remain the intellectual and exclusive property of Résidence Martyrs.

11. Archiving – Proof

Résidence Martyrs will archive order forms and invoices on a reliable and durable medium, constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.

The computerized records of Résidence Martyrs will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.

12. Settlement of Disputes

These online sales terms are subject to French law.

In the event of a dispute, jurisdiction is conferred on the competent courts of Nice.
